3. The Consumer Protection Act only provides very limited protection for buyers because private sellers are not covered by the Act.
4. The voetstoets clause is still widely used by agents and is a massive danger for buyers. (Our advice is that buyers should simply cross out the voetstoets clause in the Offer to Purchase and substitute this with a “Home Inspection Clause”.
