In South Africa, all Sectional Title Schemes are governed by the Sectional Title Schemes Management Act, 2011 (Act8 of 2011). In 2016 the Minister published the accompanying Sectional Title Schemes management regulations.In terms of section 26 of the Sectional Title Schemes Management Regulations every body corporate needs to prepare a maintenance, repair and replacement plan in accordance with rule 22 for presentation at the annual general meeting. In addition, the audit of the body corporates annual statements must include an opinion whether this requirement has been met.
